These terms and conditions apply to all forms of engagement with Fleximoms.
WorkFlex Solutions Pvt. Ltd. and its affiliates ("WorkFlex Solutions" or "we") provides its content on this Web site –
www.fleximoms.in- (the "Site") subject to the following terms and conditions (the "Terms"). By accessing and using this Site, or any of the services offered on it, you agree to be governed by these Terms, as well as any other specific terms and conditions/ rules/ guidelines/ policies posted on the site. You are advised to read the Terms carefully and independently before you use the Site. These Terms apply automatically to any new services or features introduced on the Site. There may be additional terms for any services or features you use. Kindly review these carefully.
We reserve the right to review these terms and modify and /or change and update them, so please check back from time to time. These Terms were last updated on June 01, 2011. Please refer to our
Privacy Policy to check on the practices related to collection, use and storage of user information.
All the materials contained in the e Site are provided for informational purposes only and shall not be construed as a license, an advisory, fiduciary or professional relationship between you and WorkFlex Solutions.
1. Copyrights All content and functionality on the Site, including text, graphics, logos, icons, and images and the selection and arrangement thereof, is the exclusive property of WorkFlex Solutions and is protected by international copyright laws. All rights not expressly granted are reserved.
2. Trademarks
The trademarks, service marks, designs, and logos (collectively, the "Trademarks") displayed on the Site are the registered and unregistered Trademarks of WorkFlex Solutions. You agree that you will not refer to or attribute any information to WorkFlex Solutions, Fleximoms or any property identity in any public medium (e.g., press release, Web sites) for advertising or promotion purposes, or for the purpose of informing or influencing any third party and that you will not use or reproduce any Trademark of, or imply any endorsement by or relationship with, WorkFlex Solutions and Fleximoms.
3. User Information
You may provide information on certain sections of the site. As a user, you are bound to provide true and accurate and complete information, and can update such information as necessary. Please refer to our Privacy Policy to check on the practices related to collection, use and storage of your information. This privacy policy binds only WorkFlex Solutions, its affiliates and its employees. Therefore you are advised to review and satisfy yourself as to the privacy policy of any associates or linked website where your personal information is requested.
4. Use of Site Content
WorkFlex Solutions hereby grants you a non-exclusive, non-transferable license for the term hereof to access and download, display, and print a single copy of the content and functionality displayed on the Site (the "Site Content") on any single computer solely for your internal, business use, provided that you do not modify the Site Content in any way and that you retain all copyright and other proprietary notices displayed on the Site Content, and attribute copyright to WorkFlex Solutions. You may not otherwise reproduce, modify, distribute, transmit, post, or disclose the Site Content without WorkFlex Solutions’ prior written consent.
You acknowledge that framing of our Site, or any similar process, is prohibited.
5. User Postings
You acknowledge and agree that WorkFlex Solutions shall own and have the unrestricted right to use, publish, and otherwise exploit any and all information that you post or otherwise publish on the Site in postings, survey responses, and otherwise, and you hereby waive any claims against WorkFlex Solutions for any alleged or actual infringements of any rights of privacy or publicity, moral rights, or rights of attribution in connection with WorkFlex Solutions’ use and publication of such submissions. You agree that you shall not post or otherwise publish on the Site any materials that (a) are threatening, libelous, defamatory, or obscene; (b) would constitute, or encourage conduct that would constitute, a criminal offense, give rise to civil liability, or otherwise violate law; (c) infringe the intellectual property, privacy, or other rights of any third parties; (d) contain a computer virus or other destructive element; (e) contain advertising; or (f) constitute or contain false or misleading statements. WorkFlex Solutions does not and cannot review all information posted to the Site by users and is not responsible for such information. However, WorkFlex Solutions reserves the right to refuse to post and the right to remove any information, in whole or in part, for any reason or for no reason.
6. Infringement of Copyright
WorkFlex Solutions prohibits the posting of any information that infringes or violates the copyright rights and/or other intellectual property rights (including rights of privacy and publicity) of any person or entity. You are requested to advise WorkFlex Solutions at the contact email address if you identify any content on the Website where you accurately identify the copyright has been infringed. Please include with details of the content, it’s copyright, your identity, contact, and authorization by owner of the right.
7. Disclaimers
The content and functionality on the Site is provided with the understanding that you will use the website or the services provided at your own risk with full knowledge of the information provided

- WorkFlex Solutions, its associates and affiliates, and its third-party content providers make no warranties, conditions and terms of any kind, whether express or implied as to the operation of the site or the information, materials, products, services included on this site.
- No warranty or representation on behalf of WorkFlex Solutions and its associates and affiliates, is given that:
- The quality of any products, services, information or other material purchased or obtained by you through the site or any services provided by or on the site will meet your expectations
- The site or services provided will meet your requirements
- The service will be without interruptions, always timely and secure or free from all errors
- The results that may be obtained from the use of the site or any service provided by it will be accurate or reliable
- Any errors in the software will be corrected
- Any material/contents downloaded or otherwise obtained through the use of the site is done at your own discretion and risk. WorkFlex Solutions and/or its associates and affiliates do not warrant that this site, its servers, or any mail sent from WorkFlex Solutions will not have viruses or harmful components If any damage is caused to your computer system and any losses accrue it will not be the responsibility of WorkFlex Solutions. You will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
- WorkFlex Solutions, its associates and affiliates cannot guarantee the accuracy, integrity or quality of any contents. You may be exposed to contents that are offensive, indecent or objectionable. We can only ask you to inform us immediately in order to remove any offensive material.

8. Indemnity
You agree to indemnify and hold WorkFlex Solutions and its subsidiaries, affiliates, officers, agents, and employees, harmless from any claim or demand, litigation costs, made by any third party due to or arising out of the Content you submit, post to or transmit through the Service, your use of the Service, your connection to the message board and communication areas or your violation of the Terms of Use, or your violation of any rights of any other party.
9. Termination
WorkFlex Solutions has the right to disallow you from booking and/ or buying any products on the site; it may terminate or stall your account or use of the service at its sole discretion.
It may remove and discard any content or service, for any reason, including, without limitation, for lack of use, without notice.
Any actions on your behalf that violates or is inconsistent with the letter or spirit of the Terms of Use will also make your account liable to be terminated, without prior notice and without any obligation on the part of WorkFlex Solutions. However you will be bound to clear all demands, if any, outstanding in your account.
10. Links and Third-Party Web Sites
WorkFlex Solutions has no responsibility for content appearing on the Site, which is supplied by third-party Web sites, which are governed by the Terms of Use and privacy policies, if any, of the applicable third-party content providers. WorkFlex Solutions shall have no liability or responsibility for any information published on linked web sites, contained in any user submissions published on the site, or provided by third parties. Neither WorkFlex Solutions nor its third-party content providers shall be liable for any indirect, incidental, consequential, or punitive damages or for lost revenues or profits, whether or not advised of the possibility of such damages or losses and regardless of the theory of liability
Links offered on the Site to other sites are for convenience only and do not constitute our endorsement of the linked site / page. Linked sites are not under our control and we are not responsible for incorporating any information on updates / termination of the linked sites / pages; nor for any content that appears on the linked site / page. 11. Governing Law/ Jurisdiction
The Terms of Use are governed by the laws of the New Delhi, India without reference to the principles of conflicts of laws thereof.
These terms and conditions apply to all our paid program and services.
WorkFlex Solutions Pvt. Ltd. offers Programs, Workshops and Events which are governed by the following Terms and Conditions in addition to the general Terms of Use:
Nomenclature:
Participant: any customer who pays a participant fee and attends any Program, Workshop or Event offered by WorkFlex Solutions (also ‘Fleximoms’)
Fleximoms: Fleximoms (WorkFlex Solutions Pvt. Ltd.)

Legal Entity: A company / firm / individual/ person
Product / Service: A Program, Workshop, Advisory, Event or any WorkFlex related offering made by Fleximoms
Program: Any Program, Workshop, Advisory, Event or other offerings by Fleximoms to individuals and organizations. These include, but are not restricted to:
- 2nd Chance or Workshop: Fleximoms 2nd Chance 7-step back-to-work Program
- Seal the Deal:Fleximoms 1+1 Day Sales Skills Workshop
- Money and You: Fleximoms 1 Day Workshop on Managing Money and its impact on worklife choices
- Setting up Shop: Fleximoms 2 + 1 Day Workshop for Women Professionals starting a business/ enterprise
- In Your Own Hands: Fleximoms 1 Day Workshop on raising Self-esteem and Confidence to engage with the workplace
- Skills @ Work – Fleximoms 2 Day Workshop for professionals who have been away from the workplace – addressing changing skills required.
- Business Refresher – Fleximoms intensive refresher Program for management principles, fundamentals, tools and techniques that govern business functions.
- Career Advisory: Fleximoms 90-minute one-on-one evaluation, findings and recommendations on work-life choices and next steps.
- Resume Development: Resume Analysis, restructuring, redesigning and development service
Community: The Fleximoms Community comprising the Fleximoms Team, all Participants, and any individual, company, organization or entity engaged with Fleximoms within the WorkFlex eco-system
User: Any person who accesses the website for any purpose including but not limited to transactions/ information / browsing
Associate/ Licensee: Any legal entity who displays/ sells a product / service on WorkFlexfor the purpose of transaction or information
Force Majeure Event: It means, in relation to any Party, any act, event or circumstance, the cause of which is not of such Party's making nor within that Party's reasonable control, including (to the extent not of that Party's making nor within that Party's reasonable control) Act of God, war, hostilities (whether or not war has been declared) terrorist acts, acts of any civil or military authority, government or regulatory direction or restriction, suspension or withdrawal of licenses or consents, riot, insurrection, civil commotion, public demonstration, sabotage, acts of vandalism, fire, flood, earthquake, extreme weather conditions, epidemic, explosion, the order of any court or governmental or regulatory authority, disruption in transportation or communication, breakage of or accidental damage to equipment, any strike, lock-out, or other industrial trade dispute (not involving solely the employees of that Party), structural shift or subsidence, provided always that lack of funds shall not be interpreted as a cause which is not a Party's making nor within a party's reasonable control.
Transaction: Booking and/or buying a product or service whether on-line or off-line
- Payment Policy: For Programs and Workshops:
- Once a participant confirms attendance for a Program or Workshop, payment of the full fee must be made 100% advance in the following ways:
- Upto 7 working days before the Program: Cheque, cash or bank transfer
- Upto 4 working days before the Program: Cash or bank transfer
- Upto 2 working days before the Program: cash only
- A participant is guaranteed a confirmed place only after the receipt of fee. Until receipt of fee, Fleximoms is not liable to guarantee the participant a place in the Program.
- A participant cannot choose to attend only part(s) of the Program for a lesser fee, unless defined by Fleximoms. The Program fee is for the entire program and even if a participant does not attend some of the sessions, she/he is liable to pay the full fee in advance.
- The Program fee will cover the workshop, workshop material, refreshments as defined, venue etc. All other incidentals such as transportation to workshop venues, purchases at workshop venues etc will need to be borne by the participant.

Participant Cancellation, Refund and Transfer Policy:
- On cancellations made 15 working days or more prior to the Program, a 75% refund is payable (excluding tax amount). A 25% cancellation fee is applicable.
- On cancellations made between 15 and 7 working days prior to the Program, a 50% refund is payable (excluding tax amount). A 50% cancellation fee is applicable.
- On cancellations made 7 to 3 working days prior to the Program, no refund is available.
- A confirmed seat may be transferred to any other person chosen by the confirmed participant, at the discretion of Fleximoms.
- Any cancellations made 3 working days or less before the workshop date will not receive any refund, and the amount cannot be transferred to another participant. The full amount will be forfeited to Fleximoms.
- In the event that a participant falls ill during the workshop or cannot attend a portion of the workshop once it has begun, Fleximoms reserves the right to transfer the participant to another workshop at a later date on a case to case basis. In this case, no refund will be payable and no transference of fee to another participant is possible. However the participant may be offered a place in another session of the same workshop based on the decision by the Program Faculty.
- Reviews: Where post-program reviews are applicable, Fleximoms will offer a participant two options of date and time. An email confirming acceptance of the date and time by the participant will be sent a minimum of 5 working days in advance, to the email address provided by the participant at the time of Registration. Non-response to this email will be recorded as acceptance and confirmation of the review date and time.
- If a participant cannot attend a review after confirming their attendance, they will forfeit their review session and this cannot be rescheduled.
- In case neither of the date and time options offered is possible for the participant, they may request one (1) reschedule based on other dates when reviews are scheduled by Fleximoms. If this too is not possible, they will forfeit their review session.
- In extenuating circumstances, Fleximoms reserves the right to make a decision regarding any further reschedules on a case-to-case basis, and any decision by the Fleximoms management will be final.
- Certification: Where applicable, the Fleximoms WorkFlex Readiness Certification will only be issued to participants who have completed the entire program to the satisfaction of the faculty. Any missed workshop days, review sessions or other deliverables on the part of the participant could lead to non-issuance of the Certificate. Decision of Fleximoms faculty and management in this matter will be final and a formal letter will be issued by Fleximoms to the participant stating the reasons for non-issuance of the Certificate.
- This certification is a Fleximoms certification and Fleximoms does not claim any affiliation to any other government or private institution or body.
- Getting a Fleximoms WorkFlex Readiness certification or attending any or all sessions of the programs does not automatically guarantee the participant a job.

Program Cancellation Policy:
- Fleximoms reserves the right to cancel or change the program dates and venues without allocating any reasons any time prior to the commencement of the program.
- Fleximoms exercises the right to cancel or reschedule a program based on “minimum participation requirement”. In such cases, confirmed participants will be informed about cancellation or reschedule of workshop dates 48 hours in advance and their reservation will automatically get transferred to the rescheduled workshop dates.
- In such cases, the confirmed participant may also transfer the fee to another participant.
- No refunds will be made in case of cancellation of programs.
- Any transfer must be availed of within 6 months of the original workshop date.
- In case the program on the next date selected by the participant is already full, Fleximoms will give the transferring participant priority over new participants.
- Other General Terms and Conditions:
- Fleximoms has the sole discretion of allowing / refusing a candidate from participating in a program.
- Fleximoms does not make any guarantees, implicit or explicit, to participants regarding jobs or any other nature at the end of the programs.
- While Fleximoms chooses its venue partners with great care, Fleximoms is not responsible for any damage or loss caused to the participant during the program, workshops, reviews or other events held in various venues. All participants are responsible for their own belongings and any such grievances must be taken up directly between the participant and the management of the venue where the programs are held.
- While every care is taken to ensure the quality and credibility of 3rd party partners, networks and resources, Fleximoms does not undertake any guarantees on behalf of resources, partners, companies or employers that the participant may be referred to by Fleximoms faculty and coaches. These connections are made solely to aid the participant in executing their action plan and any grievances that the participant may have with these 3rd party connections must be addressed directly with the management of the 3rd parties. Fleximoms will not be liable for any complaints made against such 3rd parties.
- Fleximoms is not liable for disruption of abandonment of the Program sessions due to force majeure circumstances beyond our control.

Conflict Resolution
Any dispute, controversy or claim arising out of or in connection with a participant’s attendance at Fleximoms programs, workshops, or other events, not covered by these Terms & Conditions or otherwise disputed; shall be finally settled by arbitration. The seat of the arbitration shall be New Delhi, India and the arbitration shall be conductedwithout reference to the principles of conflicts of laws thereof.
